ITAC issues a preliminary determination on the alleged dumping of certain flat-rolled products of iron, alloy, and non-alloy steel imported from China, Japan and Taiwan

ArcelorMittal South Africa (AMSA) brought an application for remedial action against the alleged dumping of certain flat-rolled products of iron, non-alloy, or other alloy steel of a width of 600mm or more, imported from the People’s Republic of China, Japan, and Taiwan. The application was supported Columbus Stainless Steel (Pty) Ltd.

The subject products are used across various industries, including automotive, construction and infrastructure, mining and energy, fabrication and engineering, and appliances. They are used in the manufacturing of general engineering products, such as containers, mining equipment, wheel rims, small and large bore pipes, agricultural implements, earth-moving equipment, gas cylinders, truck trailers, water tanks, and railway rolling stock.

• On 20 September 2024, the Commission initiated an investigation into the alleged dumping of these products through Notice No. 2730 of 2024 in Government Gazette No. 51271.
• The investigation was initiated after the Commission determined that there was prima facie evidence that the subject products were being imported into the SACU market at dumped prices, which was causing material injury to the SACU industry.
• After reviewing responses and comments from interested parties, the Commission made a preliminary determination that dumping of the subject products is taking place and that the SACU industry is experiencing material injury directly linked to this alleged dumping.

However, the Commission decided not to impose provisional measures. This decision was based, among other reasons, on the need to ensure a reliable supply of the subject products, as some items included in the investigation are not produced by the applicant. The Commission also advises the public that Regulation 33 of the Anti-Dumping Regulations (ADR33) does not make the imposition of provisional measures mandatory on arriving at a preliminary determination.

The investigation is ongoing, and the Commission is currently awaiting comments from interested parties regarding ITAC’s preliminary Report No. 743.
