Sunset review of the anti-dumping duties on frozen bone-in portions (chicken) imported from the United States of America: Final Determination

30 Apr 2024

The International Trade Administration Commission (“ITAC or the “Commission”) initiated a sunset review investigation in 2022 to determine whether the expiry of anti-dumping duties on frozen bone-in portions imports from the USA would likely lead to continuation or recurrence of dumping and material injury to the Southern African Customs Union (“SACU”) industry.

The initiation of the investigation followed an application submitted by the South African Poultry Association (“SAPA”) on behalf of the SACU industry, providing prima facie evidence that the expiry of the anti-dumping duties would likely lead to continuation and/or recurrence of dumping and the recurrence of material injury to the SACU Industry.

The investigation considered responses from various interested parties, including importers and industry associations.

After reviewing the evidence and comments from interested parties, the Commission made a final determination that the expiry of the anti-dumping duties would likely lead to the continuation and/or recurrence of dumping and the recurrence of material injury to the SACU industry.

The Commission made a recommendation to the Minister of Trade, Industry and Competition that the current anti-dumping duties on the imports of frozen bone-in portions originating in or imported from the United States of America be maintained.

This recommendation was approved by the Minister and a notice to give effect to this decision, has been published in the Government Gazette on 17 April 2024.

Enquiries may be directed to the investigating officer, Mr. Busman Makakola at Bmakakola@itac.org.za or Ms. Mosa Sebe at Msebe@itac.org.za
