Sunset review of anti-dumping duties on clear float glass

The Minister of Trade, Industry and Competition accepted the recommendation contained in Report 713 made by the International Trade Administration Commission (“ITAC” or “the Commission”) to maintain the anti-dumping duties on clear float glass (“the subject product”) originating in or imported from the Republic of Indonesia.

On 15 June 2022, the Commission notified interested parties that unless a substantiated request is made indicating that the expiry of the anti-dumping duties on imports of the subject product originating in or imported from the Republic of Indonesia would likely lead to the continuation or recurrence of dumping and injury, the anti-dumping duties on the subject product originating in or imported from the Republic of Indonesia would expire on the five-year expiry date of the duties.

PFG Building Glass, a division of PG Group (Pty) Ltd (“the Applicant”) submitted an application to ITAC on behalf of the South African Customs Union (“SACU”) industry. Upon initiation of the investigation, the known manufacturers/exporters of the subject product in the Republic of Indonesia were sent foreign manufacturers/exporters questionnaires to complete. Importers of the subject product were also sent questionnaires to complete.

No properly documented responses were received from any of the manufacturers/exporters or importers.

As there were no imports of the subject product from the Republic of Indonesia during the period of investigation, the Commission decided not to recommend an increase in the anti-dumping duty, but to recommend to the Minister of Trade, Industry and Competition that the current anti-dumping duties on clear float glass originating in or imported from the Republic of Indonesia be maintained. This recommendation was accepted by the Minister and a notice to give effect to this decision, has been published in the Government Gazette.
